Advertising Terms and Conditions
The company or person specific on the booking form (“The Advertiser) by signing this contract submitting any advertisement or engaging Style Magazines Pty Ltd ACN 120 955 491 (“Style”) to prepare or produce any advertisement agrees to the following terms and conditions of advertising:
- The advertiser must pay Style the price specified on the booking form prior to the printing of the month advertising in, except if 30 day terms have been agreed (and a 30 day account form has been completed) in which case a Style Account must be set up. Prepaid advertisements which are not paid prior to print will incur the casual rates and no discounts will apply. First time advertiser must pre pay at time of purchase for the first month, then pre pay before printing on each further campaign month
- The advertiser must give 30 days notice prior to publication date of change of advertising schedule agreed upon
- If the advertiser is given a schedule discount and the schedule is not completed, the advertiser must pay the difference between the discounted rate and the casual rate
- If Style is not required as detailed on the booking form to prepare and produce any advertisement, then as between the Advertiser and Style, the Advertiser solely is liable for ensuring that Style received the advertisement in an appropriate publishable form prior to any deadline which Style from time to time may set, or else Style can substitute any earlier advertisement without redress
- Style can pull or refuse to publish or republish an advertisement without explanation or redress
- Style can place words such as “advertising material” on or near any advertisement if Style considers that the advertisement resembles Style Magazines, may be mistaken for editorial material, or appears to be endorsed by Style Magazine
- Indemnity. By entering into this contract and submitting to or having prepared by Style any advertisement copy information or other material (“copy”) for inclusion in Style Magazine, or by approving any Copy, the Advertiser warrants to Style, its related companies and all their officers that the Copy and publication of the Copy: (a) does not and will not breach any (and complies with all) laws statutes regulations industry standards and the like; (b) does not infringe any right or interest (including but not limited to copyright), any other person or entity may have or assert in the Copy or any part of the copy, and; (c) is not negligent, misleading, deceptive, false or defamatory. By submitting or approving copy the advertiser agrees to and does indemnify and hold harmless Style, its related companies and all their officers, against any breach damage cost claim demand expense penalty judgment and the life (“Liability”) relating to or arising from any breach or alleged breach of any of the foregoing warranties
- The Advertiser agrees that the inclusion of (b) and (c) in (7) above is not intended to and shall not restrict the generality or interpretation of (7) (a)
- Style, its related companies, and all of their officers hereby disclaim any liability, however arising, for any negligence of any of them, and any consequence whatsoever of any negligence
- Style will take care to place and reproduce the advertisement as indicated on the booking form, but will not be responsible for any omission delay error in transmission alteration production deficiency or misplacement
- Style will not be liable in respect of any act, failure to act, or failure to perform under this agreement if caused by or resulting from any force majeure, union action, or action, or inaction of a third party (including printers or distributors) industrial dispute
- If the advertiser does not notify Style of any error in the Advertiser’s published advertisement, Style will not be liable for the same error in any republication of that advertisement
- Advertising rates are based on the understanding that space is used within the period of the order. The maximum period is 1 year. If an advertiser fails to use the total space ordered, it must pay Style the difference between the rate level ordered and the rate level used. All orders are subject to rate adjustments by Style during the period of the order
- Style does not guarantee results from advertising in Style Magazine and will therefore not give discounts or refunds upon clients claims of no results.
